Expat Instructions - Ch09 Termination

The employment contract shall be terminated in any of the cases hereunder:

  1. In the event of mutual consent by both parties to terminate the contract provided that the worker’s consent is made in writing.
  2. On expiry of the period specified in the contract unless the contract is expressly or implicitly extended in accordance with the provisions hereof.
  3. At the discretion of either party in unlimited employment contracts provided parties abide by the provisions of this Law regarding warnings & acceptable causes for termination of the contract without being arbitrary.
  4. The employer & employee may terminate an unlimited term contract for a valid reason, at any time after the conclusion thereof, by a written notice served at least 30 days prior to the termination. As for the by day workers, the period of notice shall be as follows:
    • One week if the workman/ women has been working for more than 6 months but less than one year.
    • Two weeks if the workman has been working for at least one year.
    • One month if the workman has been working for at least five years.
  5. The employer may dismiss the worker without notice in the following cases:
    • If the worker adopts a false identity or nationality or if he/she submits forged documents or certificates.
    • If the worker is appointed under a probationary period & dismissal occurred during or at the end of said period.
    • If he/she commits an error causing substantial material loss to the employer provided that the latter advises the labour department of the incident within 48 hours from having knowledge of the same.

I am working with Contracting Company as an Accountant. My designation in my work permit is Clerck because I don't have graduation certificete. Now I completed 30 months with the same employer. How many years experience required to change my profeesion in my Visa. Please advise me there any limits of salary for clerk category. Because my actual salary is more than as per my contract. Can I change my contract with my new salary.

Dear Sir,

my name is imran and I have a question. In year 2007 i used to work in dubai but due to some personal matter i had to return to my country with one month leave but later was not able to return to join my work and was terminated. Is it possible for me to apply for a job again in the UAE and get a work permit. it would be very kind of you if you reply.

Dear sir

Presently am on Wife's sponsored visa, and have been approached by a company and i have signed a labor contract which is under process however i am not happy with the company and its operation. Is it possible to cancel the labor card at this stage or else what is the minimum period i should work with the company to avoid labor ban. Also note that my visa is not transferred to company visa. Please guide me.

Hi,

I was working in a food Factory in Dubai till Feb 2007, I got a job offer from MAF Fashion L.L.C. in sales for one of their Kuwait branch. They gave me offer letter here in Dubai for their Kuwait branch on 12th of Feb 2007, as per the offer letter I was supposed to join 01st of March 2007 in Kuwait branch. They delayed me 7 months in my home country saying 3 days 1 day tomarrow, we will get your visa. and then I contacted HR Manager directly she gove me an option coming back to dubai. I came back to dubai on 21st of Sept 07, they gave me another offer letter for dubai, and started my work on 23rd sep 07, and now due to very small reson  of taking tea they gave me redundancy leter on 15th of  Dec 08. Now, I want to know can I have any power to ask them for my compansation because I still have my old and new offerletter in my hands.My performance at work was excellant. I tried to show to my Manager while he was dusscussing about my redundancy leter. He was thrutning me when I tried to defend me and due to that I signed that letter. My contract is unlimited.
