Expat Instructions - Ch10 EoService Benefits

  1. 1. The worker, who has completed one year or more in the continuous service, is entitled to the end of service benefit at the end of his/her service. Days of absence from work without pay are not included in computing the period of service, & the benefit is to be calculated as follows :
    • Twenty one days pay for each year of the first five years of service.
    • Thirty days pay for each additional year provided that the entire total benefit shall not exceed two years pay.
  2. 2. The end of service benefit shall be computed on the basis of the last salary which the worker was entitled to, in respect of those drawing their salary per month, week or day, & on the basis of the average daily wage stipulated in Article (57) in respect of those drawing their wages on piece work basis. Allowances are not included.
  3. 3. If a worker under a contract with unlimited period has left his/her work at his/her own option after a continuous service of not less than one year & not more than three years, he/she shall be entitled to two third of the end of service gratuity provided for in the previous Article, where the coemtinuous period of service exceeds 3 years but 5 years, he/she shall be entitled to tow thirds of such gratuity. If the period of his/her continued service exceeded 5 years he/she becomes entitled to the full benefits.
  4. 4. If a worker under a contract with limited period leaves his/her work before the end of the contract period he/she shall not be entitled to end of service benefits unless the period of his/her continuous service exceeds five years.
  5. 5. The worker shall be fully deprived of the end of service benefit in any of the following cases:
    • If he/she is dismissed from service for any reason in accordance with Article (120) of the Labour Law which are listed in Part VIII, paragraph 5 of this guide.
    • If he/she leaves his/her work willings & without notice in cases other than those enumerated in Article (121) of the Labour Law with respect to unlimited period contracts or before he/she completes five years of continuous service with respect to limited period contracts.

I am a good wife & employee here in dubai since year 2006.

When my husband got a new job from ITD Design LLC he decided to resign from the company of Arabian construction Company (ACC) as an Architect until July 12, 2008.

He started last July 13, 2008 in ITD Design LLC. During that time he still has remaining days to stay in dubai as ACC cancelled his employment VISA, that’s why ITD Design LLC has a time to process his new employment visa with them.  ITD DESIGN LLC company has a business partner is name ABDULRAHMAN FALAKNAZ, who also owned FALAK PROPERTIES, who is also ITD DESIGN LLC client that is responsible for the payment  & ITD Design’s financial dues.  

Eversince my husband started working in ITD Design LLC, FALAK PROPERTIES is the one who pay his salary by giving him bank cheque signed by the owner himself

Last September 2008, ITD Design asked a favor to my husband if I can sponsor him as “wife visa” for the meantime due to the delay of renewal of ITD Design LLC trade license with Mr. ABDULRAHMAN FALAKNAZ side to avoid exit going back to the Philippines and to avoid the delay of work as he appointed to. As they promised to my husband that as soon as they got renewed their trade license they will immediately give my husband an employment visa.

I’ve made it, I got processed my husband a visa. I sponsored him as “wife visa” which stamp &

Validated September 14, 2008 and it will expire on Septmeber 15, 2011. The time goes by I didn’t heard any feedback from ITD Design LLC and besides according to my husband, one month salary has been taken from him and will be return until they processed him a visa and or if he resigned to the company. In which has been advised by the FALAK PROPERTIES P.R.O.  

On February 2009, ITD Design started to cut his salary into hals as well as the work time schedule to the economic global recession. My husband on that time can’t resign because of the 1 month salary that has been taken last December 2008. He continue at working promising to him that it was only temporary.  

On May 2009, He attempted to resign but his manager refused to accept it due to the payment or financial stability of ITD Design LLC is on the hands of FALAK PROPERTIES, and ITD DESIGN LLC doesn’t have enough money to pay me and FALAK PROPERTIES should be.  

On July 17, 2008, my husband tender his resignation, it was accepted by his manager without knowing that both partners having a gap due financial. And this is also the day of  ITD DESIGN LLC close the office by FALAK PROPERTIES.

    I am working in the company for 2 years and 6 days for limited contract and i was terminated for negligence, the company will not give me the gratuity because i did not finish my 3 years contract But it is in the law that they will not give me also my return ticket allowance since i finish my 2 years which stated in my offer letter and contract. They told me that i will receive 4,270 DHS but when i went to the office they told me that i cannot receive the allowance because i was terminated....Pls Help me!

Dear Sir,

In chapter 10 and clause 3, there is a mistake as to the Gratuity for persons whose service is less than 3 years and more than one year. The gratuity is only one-third and not two-third. Please correct the same at your earliest.
